In order to promote consistency and assist the courts, personal injury solicitors and other advisers, the Judicial Studies Board publish a set of guidelines for the level of injury awards for a broad range of injuries. The information, which follows, has been taken from those guidelines. Whilst the guidelines are very useful and provide a good general indicator of the level of damages which may be paid, it should be remembered that no two cases are ever the same and general damage claims for injuries resulting from accidents will always reflect the individual circumstances of the particular in dividual and the injuries he or she has suffered and claims will be assessed accordingly.

Accidents Resulting in Neck Injury Claims

There is a very wide range of personal injury compensation claims settlement for neck injuries starting from as little as £500 and going all the way up to £77,500 or thereabouts.

Where the injury to the neck is very serious and is associated with degrees of paraplegia or quadriplegia, where there is a very little movement in the neck and the accident victim suffers constant headaches, claims at the upper end of the scale - in the region of £77,500 - may be paid.

Injuries may lead to claims settlement in the region of £34,000 to £67,500 where there is some level of serious disability and there is permanent damage to a degree but not as serious as that appearing in the upper bracket.

As we move down the personal injury compensation claim scale for these types of personal injury, we find that injuries causing serious soft tissue damage coupled with, perhaps, damage to tendons which is permanent and leaves the accident victim dealing with a level of permanent disability, compensation may be paid in the region of about £27,500.

Compensation claims awards for personal injury fall into a lower bracket of between £13,000 to £17,000 where the accident victim makes a claim for fracture and dislocation type injuries with lasting restriction of movement and the vulnerability to further injury.

Accidents resulting in the worst whiplash types of personal injury, would attract compensation claims awards in the region of £7,250 to £13,000. In these types of claims, the accident victim would typically be suffering from serious limitations in movement, permanent pain and discomfort. There may also be the need for further surgery in the future and a degree of vulnerability to further injury.

In accidents leading to moderate whiplash injuries to the neck, claims for personal injury compensation should be paid in the region of £4,000 to £7,250. Claims for these types of injuries will be for conditions where there is complete recovery or virtually complete recovery from the effects of the personal injury within a few years.

Compensation claims awards of about £500 to £4,000 would be expected to be made in minor cases. This is quite typically the range of claims awards paid in accidents leading to 'run of the mill' whiplash type neck injuries. At the lower end of the scale, recovery from the personal injury would take place within a few weeks whereas a recovery period of about two years would lead to compensation claims settlement at the upper end of the scale.
