In order to promote consistency and assist the courts, personal injury solicitors and other advisers, the Judicial Studies Board publish a set of guidelines for the level of injury awards for a broad range of injuries. The information, which follows, has been taken from those guidelines. Whilst the guidelines are very useful and provide a good general indicator of the level of damages which may be paid, it should be remembered that no two cases are ever the same and general damage claims for injuries resulting from accidents will always reflect the individual circumstances of the particular in dividual and the injuries he or she has suffered and claims will be assessed accordingly.

Claims for Asbestosis Related Disease Injuries

There are three main types of asbestosis related diseases leading to claims. They are the Mesothelioma, lung cancer and asbestosis. Mesothelioma does not usually last as long as the other two but is usually fatal between 6 and 18 months from when it is first diagnosed. Although suffering from the other two conditions tends to be of longer duration, ultimately, they also usually prove fatal.

Claims for compensation for Mesothelioma may expect to be satisfied for between £40,000 and £60,000. The condition usually severely affects quality of life and causes high levels of pain and affects the ability of the body to function properly. It attacks the lung lining and also the lining of the abdominal cavity causing severe pain in both types of case. The level of compensation claims awards within the bracket are determined by the duration of pain and suffering. Typically, compensation awards paid at the lower end of the scale will be where there has been suffering for between 6 and 9 months and up to 3 or 4 years that the upper end of the scale.

Lung cancer victims may expect to have their claims for compensation for personal injury settled for between £40,000 and £50,000. Once again, claims will be paid at the higher end of the scale depending on the duration of pain and suffering.

Asbestosis compensation claims awards should be paid out between about £25,000 and 55,000. Asbestosis is the condition whereby the function of the lungs is affected making it difficult to absorb oxygen into the bloodstream. As the condition worsens, victims suffer increasing breathlessness and mobility is also likely to be affected.
